About Shivamogga Court

District & Sessions Court, Shivamogga has been established before 1-6-1956 as per acquittance roll maintained in this Court.Formerly, Shivamogga District & Sessions Court had jurisdiction over the three District of Shivamogga, Chitradurga and Chikmagalur. Its jurisdiction was confined to the Shivamogga District after new District Courts were established at Chitradurga and Chikmagalur with effect from 01-10-1964 and 01-11-1965 respectively.Shivamogga District Court had administrative control over the Districts of Shivamogga, Chitradurga and Chikmagalur till 19-10-1978 and from that date the above three Districts have independent administration over their respective Districts. District & Sessions Judge is the highest judicial authority in the District. A spacious composite Court building was constructed near the Deputy Commissioner’s office at Balraj Urs Road, Shivamogga to house the various Courts at Shivamogga which started function from 02-12-1973.

CIVIL COURT

  • Pecuniary and other Jurisdiction: To try, hear and dispose of
    • Original suits-unlimited jurisdiction.
    • Appeals against the judgments of the Senior Civil Judge, Shivamogga, Sagar, Bhadravathi and Sorab where the pecuniary value does not exceed Rs. 10 Lakh.
    • Execution cases relating to suits disposed off by this court and relating to decree transferred from other courts to this court.

CRIMINAL COURT

  • Special Jurisdiction: To try, hear and dispose off: 1. Sessions Cases. 2. Criminal Appeals. 3. Criminal Revision Petitions. 4. Criminal Misc.cases.
    • Compensation claim cases U/S 110-A of the Indian Motor Vehicles Act, 1939.

    • Appeals U/s 6 of the Karnataka Private Educational Institutions (Discipline and Control) Act, 1975.

    • Cases coming under the provisions of the State Finance Corporation Act, 1951.

    • Cases filed under the provisions of Indian Succession Act and Appeals preferred in respect of cases under the said act disposed of by the Subordinate Courts.
    • Appeals preferred under the Karnataka Public Premises (Eviction of Unauthorised occupants) Act, 1961.
    • Appeals filed under the provisions of Karnataka Village Panchayath and Local Boards Act, 1959.
    • Appeals filed under the provisions of Karnataka Municipalities Act 22 of 1964 relating to the Election of President and Vice Presidents of the Municipal Councils.
    • Execution Cases relating to compensation claims cases under Sec. 110-A of the Indian Motor Vehicles Act, 1939 disposed of by this court (Inserted as per Govt. Notification dated 6th January 1984 under No. HD 8 TRR 82).
    • Cases relating to Election disputes of Adhyaksha and Upadhyaksha of Zilla Parishad under Sec. 165 of Karnataka Zilla Parishad’s Act 1983. 
    • To hear and dispose of all the appeals arising out of Conviction and sentences passed by the Magistrates under the provisions of the Special Enactments.
    • Cases filed under the Prevention of Corruption Act.  
    • Revision cases arising out of the cases relating to property tax matters under the Karnataka Municipalities Act No. 22 of 1964.
    • Cases filed under the provision of Scheduled Caste / Scheduled Tribes (Prevention of Atrocities) Act 1989.
    • Cases filed under Narcotic Drugs and Psychotropic Substance Act.
    • Cases filed under Section 153 of Electricity Act, 2003.
